Blue Best, LLC, doing business as Blue Best Plumbing, Heating, Air & Generators (“Blue Best,” “we,” “us,” or “our”), is committed to protecting the privacy of our customers, prospective customers, website visitors, and event participants. This Privacy Policy describes the personal information we collect, how we use and share it, the choices you have, and how to contact us with questions or to exercise your rights.
This Policy applies to all of Blue Best’s data collection activities, including:
- Our website at www.bluebest.com (the “Website”), including any web forms, online chat, online scheduling tools, and online financing applications;
- Our home-services business, including heating, air conditioning, plumbing, generator, indoor air quality, and related services delivered at customer homes and businesses;
- Customer communications by phone, text message, instant message, email, and mail;
- Marketing activities, including advertising campaigns, promotional emails, sweepstakes, contests, giveaways, and sponsored events;
- Financing applications submitted to our financing partners (where applicable);
- Information we collect through cookies and similar technologies on the Website.
This Policy does not apply to: information we collect from job applicants or employees in the course of hiring or employment (which is governed by separate practices and applicable employment law); or information collected by third-party websites or services we link to (which is governed by their own privacy policies).
By using our Website, requesting our services, providing your information to us at an event, or interacting with our marketing communications, you acknowledge that you have read this Privacy Policy.
1. Information We Collect
The information we collect depends on how you interact with us. We may collect the following categories of personal information:
Identifiers and contact information. Your name, mailing address, service address (if different), email address, phone number, and (for some services) a customer account identifier.
Service information. Information about your home and the services you request from us, including the type of equipment installed or serviced, model and serial numbers, service history, photographs of the work area or equipment that our technicians take to document the work, scheduling preferences, and notes our technicians make during service visits.
Payment information. When you pay for our services, payment-card information is processed by our payment vendors and is not stored on Blue Best’s systems in full. We may store the last four digits of a payment card and the card brand for purposes of customer service and fraud prevention. We comply with the Payment Card Industry Data Security Standard (PCI DSS) for handling of payment-card information.
Financing information. For customers who apply for financing through our third-party financing partners, the financing application information is submitted directly to and underwritten by the financing partner. We may receive confirmation of approval and the approved financing amount, but we do not collect or retain the credit application data ourselves.
Communications. Records of phone calls (which may be recorded for quality assurance and training, with notice given at the start of the call), text messages, emails, web-form submissions, online-chat transcripts, and reviews you submit about our services.
Event and promotional information. If you enter a sweepstakes, drawing, giveaway, or other promotional event we sponsor, we collect the information you provide on the entry form, including your name, contact information, age confirmation, residency confirmation, your signature, and any optional marketing opt-in selections.
Website usage information. When you visit the Website, we automatically collect information sent by your browser, including your IP address, browser type and version, operating system, the pages you visit, the time and date of your visit, the time spent on each page, and the website you came from. We use cookies and similar technologies to collect this information — see Section 5 (Cookies and Tracking Technologies).
Marketing information. Records of which marketing communications we have sent to you, whether you opened them or clicked links, whether you have unsubscribed or opted out, and your preferences for the types of communications you receive.
Tax-reporting information for prize winners. For sweepstakes prizes valued at $600 or more, we collect a tax identification number (such as a Social Security number) and complete IRS Form W-9, solely for purposes of preparing IRS Form 1099-MISC as required by federal tax law. For prizes valued under $600, we do not collect tax identification information.
We do not knowingly collect health information, biometric data, precise geolocation data (beyond ZIP-code-level service-area information), or other sensitive categories of personal information. If you provide such information voluntarily, for example, mentioning a health condition that affects your service request, we treat it as part of the service-information record and limit access accordingly.
2. How We Use Your Information
We use the information we collect for the following purposes:
- Providing the services you request, including scheduling, dispatching technicians, performing the work, providing estimates, processing payments, and following up after the service.
- Processing payments and managing financing arrangements.
- Communicating with you about your account, your service, our products, and our services, including service reminders, equipment-warranty notifications, and seasonal maintenance recommendations.
- Sending you marketing communications, but only if you have opted in or if you are an existing customer and the communications are reasonably related to the services you have received from us.
- Administering sweepstakes, contests, giveaways, and other promotions, including verifying eligibility, contacting winners, delivering prizes, and preparing required tax forms (for prizes valued at $600 or more).
- Responding to your questions, requests, complaints, and reviews.
- Improving our website, services, and customer experience, including by analyzing aggregated usage patterns.
- Maintaining records for tax, accounting, warranty, regulatory, and other legal compliance purposes.
- Detecting and preventing fraud, abuse, security incidents, and unauthorized use of our services.
- Complying with applicable law and responding to lawful requests from law enforcement, courts, and regulators.
- Conducting our business operations, including planning, hiring contractors, managing supply chains, and similar internal functions.
3. How We Share Your Information
We share your information only as described below. We do not sell your personal information to third parties for monetary consideration.
Service providers and vendors. We share information with vendors who perform services on our behalf, including payment processors, scheduling and dispatch software providers, customer-relationship management (CRM) platforms, email and SMS marketing providers, web hosting and analytics providers, financing partners, and prize-fulfillment vendors. These vendors are contractually required to use your information only for the purposes we specify and to maintain appropriate security measures.
Co-sponsors and event administrators. For sweepstakes, contests, or events that we conduct jointly with another organization, we share entry information with that organization for purposes of administering the promotion. The privacy notice provided at the time of entry will identify any such organization.
Manufacturer warranty registration. When we install equipment that requires warranty registration, we may submit your name, address, and equipment information to the manufacturer to register the warranty on your behalf.
Advertising partners. We use online advertising platforms (which may include Google, Meta/Facebook, and similar platforms) to deliver advertising about our services. To make this advertising more relevant, our Website may include tracking pixels or tags that share limited information (such as the pages you visited on bluebest.com or whether you completed a contact form) with these platforms. You can control how these platforms use your information through their own privacy controls (linked in Section 5) and through your browser’s cookie settings.
Legal and regulatory disclosures. We may disclose your information if required by law, in response to a subpoena or court order, to comply with a regulatory inquiry, or to protect our rights, the rights of others, or the safety of any person. We also may disclose your information to local municipalities to apply for permits required to conduct the services you request.
We do not sell your personal information for monetary consideration. Some state privacy laws define “sale” or “sharing” to include the use of online advertising tags as described above; we provide opt-out mechanisms for such use through your browser cookie settings, the advertising platforms’ own controls, and, where required by applicable law, a dedicated opt-out mechanism described in Section 7.
4. International Data Transfers
Blue Best is based in Utah and primarily serves customers in Utah. Some of our service providers (including SaaS platforms for CRM, email marketing, and analytics) may process data on servers located outside the United States. We require these providers to maintain data protection standards consistent with this Privacy Policy and applicable law.
5. Cookies and Tracking Technologies
Our Website uses cookies and similar technologies to collect information about your use of the site and to improve your experience. Cookies are small text files stored on your device by your web browser. We use the following types of cookies and tracking technologies:
Strictly necessary cookies, which are required for the Website to function (for example, to enable secure form submission).
Analytics cookies, which help us understand how visitors use the Website. We use tools like GOOGLE ANALYTICS to deploy these cookies.
Advertising and marketing cookies, which may be used by our advertising partners to deliver advertising on other websites that may be relevant to you based on your visit to our Website. These may include services like GOOGLE ADS and META PIXEL.
You can control cookies through your browser settings. Most browsers allow you to refuse cookies, delete cookies, or be notified when cookies are sent. Refusing cookies may limit the functionality of the Website.
You can also manage your preferences with major advertising platforms directly:
- Google Ads / Analytics: adssettings.google.com
- Meta (Facebook/Instagram): facebook.com/adpreferences
- Industry-wide opt-out: optout.aboutads.info (Digital Advertising Alliance) or optout.networkadvertising.org (Network Advertising Initiative)
Some browsers offer a “Do Not Track” signal. We do not currently respond to such signals because no consistent industry standard exists for them.
6. Marketing Communications
We may send you marketing communications by email, text message, or mail about our products, services, special offers, and events. We send marketing communications only if (a) you have opted in (for example, by entering a sweepstakes and checking the marketing-opt-in box, or by submitting a contact form on our Website), or (b) you are an existing customer and the communications are reasonably related to the services you have received from us, as permitted by the federal CAN-SPAM Act.
All marketing emails from Blue Best comply with the federal CAN-SPAM Act, including:
- Accurate “From,” “To,” reply-to, and routing information identifying Blue Best as the sender;
- Subject lines that accurately reflect the content of the message;
- Identification of the message as a commercial communication;
- Our valid physical postal address (provided in the “Contact Us” section below);
- A clear and conspicuous unsubscribe mechanism;
- Honoring of unsubscribe requests within ten (10) business days.
Marketing text messages from Blue Best comply with the federal Telephone Consumer Protection Act (TCPA). We send marketing text messages only with your prior express written consent, which you provide by checking the SMS marketing box on an entry card, online form, or other consent mechanism. Marketing text messages will:
- Identify Blue Best as the sender;
- Include the disclosure, “Message and data rates may apply”;
- Are typically sent one to four times per month;
- Include the instruction, “Reply STOP to unsubscribe,” in the initial message and on a periodic basis;
- Stop sending immediately upon receipt of a STOP request.
You may opt out of marketing communications at any time:
- Email: Click the “unsubscribe” link at the bottom of any marketing email.
- Text message: Reply STOP to any marketing text message.
- Phone: Call us at (801) 801-BEST (2378) and ask to be removed from our marketing list.
- Mail: Write to us at the address in the “Contact Us” section below and ask to be removed from our marketing mailing list.
Even after you opt out of marketing communications, we may still send you transactional or service-related communications about your account, scheduled service appointments, billing, and similar non-marketing matters.
7. Your Choices and Rights
Depending on where you live and the nature of our relationship, you may have certain rights regarding your personal information. These may include:
- Access. You can request confirmation of whether we process your personal information and a copy of the personal information we hold about you.
- Correction. You can ask us to correct information that is inaccurate.
- Deletion. You can ask us to delete your personal information, subject to exceptions for information we are required or permitted to retain (for example, for tax, warranty, or legal-compliance purposes).
- Portability. You can request a copy of the personal information you have provided to us in a portable, machine-readable format.
- Opt-out of marketing. You can opt out of marketing communications as described in Section 6.
- Opt-out of sale or sharing. We do not sell personal information for monetary consideration. We use online advertising tags as described in Sections 3 and 5; you can opt out of such use through your browser settings, through the advertising platforms’ own controls, or by contacting us using the methods below.
How to exercise your rights
To exercise any of these rights, contact us using one of the following methods:
- Email: privacy@bluebest.com
- Mail: Privacy Request, Blue Best, LLC, 600 N 500 W, Suite D, Bountiful, UT 84010
- Phone: (801) 801-BEST (2378)
We will acknowledge your request within a reasonable time after receipt and will respond substantively within forty-five (45) days. If we need more time, for example, because the request is complex or we need to consult our records, we may extend the response period by an additional 45 days, in which case we will notify you of the extension and the reason.
Identity verification
Before responding to a request, we will verify your identity to make sure we are not disclosing your information to someone else. We may ask you to confirm information already in our records (such as a recent service date, your service address, or the last four digits of a payment method on file). For sensitive requests, such as deletion of all records, we may require additional verification, such as a signed written request or government-issued identification. If we are unable to verify your identity, we will notify you in writing and will not be able to process the request. We do not retain verification documents longer than necessary for this purpose.
Authorized agents
You may designate an authorized agent to make a request on your behalf. The agent must provide proof of authorization (such as a signed permission letter or a power of attorney), and we may still need to verify your identity directly to confirm the request.
Fees and limits
We do not charge a fee for responding to your first request in any 12-month period. We may charge a reasonable fee for additional requests within the same period if they are excessive or repetitive, or we may decline to respond and explain why.
Utah residents
Utah residents have rights under the Utah Consumer Privacy Act (Utah Code § 13-61-101 et seq.), which became effective December 31, 2023. The UCPA applies to certain businesses that meet specific revenue and data-processing thresholds. Blue Best is a regional home-services business and does not currently meet those thresholds, so the UCPA does not technically apply to us. We nonetheless strive to handle privacy requests from Utah residents in good faith and consistent with the principles described in this Section. We may not be able to fulfill every request, for example, we are required by tax, warranty, and other applicable laws to retain certain records, and operational realities may affect our response timeframes, but we will respond to requests reasonably and will explain any limitations.
8. How Long We Keep Your Information
We retain your personal information for as long as necessary to fulfill the purposes for which it was collected and to comply with our legal, regulatory, and business obligations. In general:
- Customer service records are retained for the duration of the customer relationship plus twenty-five (25) years for tax, warranty, and regulatory purposes.
- Marketing-opt-in contact information is retained until you unsubscribe, after which we retain a record of your opt-out so we do not contact you again.
- Sweepstakes and event entry information is retained for the duration of the promotion plus three (3) years.
- Website analytics data is retained for up to twenty-six (26) months in our analytics systems.
- Financial records and tax-reporting information are retained for seven (7) years (or as long as required by applicable law).
- Communications records processed through our CRM (call recordings, emails, chat transcripts) are retained for seven (7) years. We will determine the appropriate retention for written communications processed outside our CRM on a case-by-case basis.
When we no longer need your personal information, we securely delete or de-identify it.
9. Data Security
We use commercially reasonable physical, technical, and organizational measures to protect the personal information we collect from unauthorized access, use, alteration, and disclosure. These measures include access controls, vendor due diligence, secure transmission of payment-card information through PCI-compliant processors, and employee training on data protection. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
If we become aware of a security breach affecting your personal information, we will notify you and the appropriate authorities as required by Utah Code § 13-44-202 (the Utah Personal Information Protection Act) and other applicable law.
10. Children’s Privacy
Our services are not directed to children under thirteen (13) years of age. We do not knowingly collect personal information from children under thirteen. If you are a parent or guardian and you believe we have collected personal information from a child under thirteen, please contact us at the information below and we will promptly delete the information.
Our sweepstakes and other promotional events are limited to entrants eighteen (18) years of age or older.
11. Third-Party Websites and Services
Our Website may contain links to third-party websites and services, including social media platforms, financing partners, manufacturer warranty pages, and review sites. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party website or service you visit.
12. Filing a Complaint
If you have a privacy concern that you believe we have not adequately addressed, you may file a complaint with the following authorities:
- Utah Attorney General, Division of Consumer Protection: dcp.utah.gov, (801) 530-6601.
- Federal Trade Commission: reportfraud.ftc.gov or (877) 382-4357.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this Policy and post the updated Policy on our Website.
If we make material changes that affect how we use your personal information, we will provide additional notice before the changes take effect. Notice may include any of the following: a prominent banner on the Website for at least thirty (30) days, a notice email to customers and contacts on our marketing list, or a notice included with a routine customer communication. Material changes do not apply retroactively without your consent.
Please review this Privacy Policy periodically to stay informed about our practices.
14. Governing Law
This Privacy Policy is governed by the laws of the State of Utah, without regard to conflict-of-laws principles. Disputes regarding this Policy will be resolved exclusively in the state or federal courts located in Davis County or Salt Lake County, Utah.
